והיינו דקא קשיא ליה לר"י השתא דאמרת חס רחמנא עילויה דמזיק דשקיל בשבחא יכול שור שוה חמש סלעים שנגח שור שוה מנה והנבילה יפה חמשים זוז זה נוטל חצי החי וחצי המת וזה נוטל חצי החי וחצי המת
